Why does someone as honorable as Kim want to sue another party like me without that other party (me) knowing about it? Logic dictates only two possible answers: 1) To present a very one-sided story to the court 2) To sneak a judgement past that other party
  • So we went from lease, to supposed co-own, to a conned make-belief own with Nando.
  • Then we have the purchase confirmation of Esie von uns Heimaturt, BH, supposed to be paid off from her first litter, which never happened, and consequently she is not paid off, and instead I am told I can sell her. Which I do, at a loss, and then nearly cannot get her released to her now owner.
  • Then we have the purchase confirmation of Gesi von uns Heimaturt, SchH1, which is never completed. Gesi is finally sold elsewhere for the 3900€ but without any litters from breeding leases and is eventually shipped out.
  • The next purchase confirmation was for Asta vom Berry Hof, SchH1, which is also never completed. Her first litter never happens, because Kim flat out refuses to breed her, unless I hand over papers for Nando. Not gonna happen. Then she refuses to release the dog period. I have no idea where this dog is. Anyone?
  • Elly - Eilin vom Haus Gremm SchH3 - was never up for purchase for Kim, she was there for a breeding lease. Two botched attempts at litters, the first time 5 pups are lost, second time another 5. And the dog too, because I have no idea where she is. Anyone?
  • Then there is Vito vom Haus Ellernbach, who is supposed to be purchased but also never paid off, but attempted to be basically converted into Kims property without finalizing payment. Now he is listed on the von Hayden Website for sale. I wonder if he is being offered without papers...
    Interestingly, people mention my whereabouts. von Hayden Shepherds makes it appear on their website that they are still in NY state, even have a NY state phone number listed. Above lawsuit states von Hayden Shepherds LLC, WV. But if they do it, that is ok.
  • And then there is also Wenke. I was told again and again she was a nutcase of a pup, not placable. Requests of proof of that so that I can get a replacement from the breeder were not met. I was sent some videos that did not show a nutty puppy, just a disobedient one. I asked to have Wenke sent to me, no go. Then I was told Wenke could be placed with a non-profit organization that would re-habilitate her and find a home for her. Ok, lets find a solution for that dog, under the condition that they send me a tax receipt, and something that proves that the dog is unfit for regular placement, and that she will be spayed, papers will be returned to the breeder. That way I can get my re-imbursement from the breeder. Well, no tax receipt, but I did get this eMail from the people that got her. Apparently Kim really has gotten used to that habit to be very, very generous with my property. I was not aware until then that I had this habit of gifting all these dogs away to breeders so that they may breed them:

Interesting that they could not be reached by phone and eMails were unanswered, so I guess this dog has made another disappearing act, easy for them to say abandoned when they do not respond. Maybe I should not have emailed that I had most certainly not agreed to donate a dog for breeding purposes, especially one that I was told is not breeding quality because of temperament issues (mind you she was raised by von Hayden since she left her kennel in Germany), and we do not donate free dogs for breeding period. For services, yes, sometimes. But then the dogs most certainly go with no papers and properly de-sexed, or has that as a condition, most do anyways. Why this organization would need papers on their service dogs raises a couple of eyebrow anyways. At least they do not seem to think finding a pet home for Wenke would be a problem, so why Kim had an issue with that I am not sure. When you scroll back up, Kim asks what she owes for Wenke. No payment was ever made on her. To this organization Kim presented herself as co-owner of this female.   Where have we seen this before?       It is late. Enough for now. Happy reading. Happy bashing. I might be back in a day or two. Someone please do some cliff notes for me, because I do not have time to read through all this.

3crzygsd   Sounds like you are caught in the middle of a bad situation.  I feel bad for you and the dog.  You should get a refund, but I doubt Von Hayden has it.  Looking at the above emails sounds like she is in over her head.

DH  Thanks for the post it was a real eye opener.

Yellowrose   Always the first to throw stones.  Have you had your breeding stock hips xrayed yet?

Von Hayden Kennels  What a disappointment to your puppy buyers and for our breed.  If you say your going to do something then do it.

There are still things that don't make sense to me...why are registration papers so important in this transaction to you in the first place, if you had no intentions of breeding the dog when you purchased her?  I have seen proof that you did indeed purchase this dog as a pet.   If you simply want to show that she is purebred, you yourself could easily have a pedigree done up to show the dog's ancestry, and/or I am sure that Kimberly could provide you one as well, and then follow up with DNA testing to confirm parentage on the sire and dam of your pup...not a problem there.

 

   ----DDR, papers are important because she paid 1,800 for a fullbred GSD from a breeder that were suppose to have papers. If she didn't want papers she could of adopted a dog. The dog has a natural nose for tracking and could do a BH in the future. Why should she do things like this and then have a score book that says MUTT/MIX BREED. An $1,800 MUTT. Come on. Why are you putting so much effort into a post that really doesn't concern you? Pretty interesting emails i just read above. I have nothing against you DDR but stop with the "it's ok not to have papers". Maybe for you but not for everyone. As far as taking 1 1/2yrs to 2yrs register a dog from SV to AKC isn't true anymore. Back in the day when AKC didn't know better i would agree. But now it's quick. A friend of mine did it with a SchH1 import. It took 2 months. I imported a puppy from Karthago kennels and it was done in a couple of months.

Might work for a lot of other disputes too.

Personally I like the romance of a duel with 200 year old pistols.

Pool cue's might take too long.

The pool cue thing is a take-off on a Christmas day tradition in my own family. Fight to the death. Last one standing gets all the presents. I truly hope everyone involved gets this mess sorted out satisfactorily.

I'm glad to know that you can be easily reached by phone, always just a ring away as long as you think you've got a buck to make off someone.  Why don't you share your current phone number with me, and while you're at it, how about a valid address?  I have some papers to send you with compliments from my attorney.
 
Unfortunately I am not an liberty to post a proper response on a public forum such as this, as you are well aware I don't just threaten to use a lawyer to protect the interests of my clients, I have one, and I have legal cases pending and this restricts what I can post.  It's clear that you don't have legal counsel yourself or your lawyer never would consented to publish the private correspondence that you did.
 
The good news is, the legal system of the United States of America, which you so despise and insult in your posts, is willing to appoint you an attorney if you cannot afford one.
