THe only person I take advise from is my lawyer. I think everyone who has been screwed should log disputes with the commitee at the AKC so it can stop them from continuing.

I dont know Daniela Hupe from a hole in the wall and she seems as crazy as the rest of the people I have been involved with in this matter.  What the hell would I take advise from another shady dog person for? Already screwed once...

I am sorry you got screwed....and I am sorry to all of the othes.

As Kim is advising you I am sure she will confirm the only person she got letters from was my lawyer in NJ.  Not a crazy alleged dog dealer in Canada or where-ever she claims to be. 

Think about what you are saying there are many people on this board that having been trying to find this DH person and some how I was able to find her and chat with her and get her to advise me.  HELLLOOOOO.........its almost comical....what you suggest.

At the end of the day I hope it works out for everyone and or the bad breeders are stopped from their unethical actions.

It's very true that it takes time to get your papers back if you dealing with an import, my rule is I never worry till about 1.5 year. After that I might get little bit upset. I sugest for both parties involve to grow up and settel it face to face. S...t happens every day, sometimes honest two way conversation can solve more than any other b/s including lawyers, as they don't care the only thing they care is about your money.

Make no mistake...you have been used by DH to her advantage...you are her window for information on what is going on with one of the FEW people who have ever been successful in getting DH into court much less winning the case. 

I didn't say no one can contact DH...I'm saying that only those who are buyers who she might be able to get money from, or people who can benefit her somehow in her manipulative schemes to scam buyers are people she chooses to correspond with.  The others can email her till the cows come home..

DH won't let it be immediately evident what her motives are...obviously it wouldn't benefit her to tell you that she intends to use you for a period of time so she can screw someone out of their hard earned money....
pretty sure that information would effectively prevent her from being successful in further scams.

Interestingly enough she does not respond to the RCMP who is trying to locate her. 
Maybe you could inform her that they want her to contact them and have her ask for Constable Kevin R Shaw. 
He is the detective who is looking to speak with her.  Belileving she will never contact them as she has already demonstrated, you can contact them on her behalf.  Email me privately if you need more contact information for this.

I myself have no need to contact her any further...for me, the paperwork on the dog I purchased from her for breeding has become a mute point...the dog she sent me had only half a uterus, could not carry full term a viable litter, and has since been spayed.  Instead, it is the principle of the matter with me, that she is a rip off artist that continues to do business in this manner and continues to elude those who are trying to make her accountable for her actions.
 
I have reported this fraud by DH to AKC / Attn: Jill Zapadinsky,  Supervisor / Case Management at AKC. Also to the State Attorney General's Office...to the RCMP in Canada and also to the SV..  Simply stated, no one can locate her physical whereabouts unless she choses to tell them where it is...she uses a Post Office box and their physical address to make herself appear legimate.  She corresponds very effectively with the SV;  by phone, via email and the use of her PO Box with their physical address. 

Is it possible that you are being encouraged by her to stir up the pot all the while she knows that she is the one preventing paperwork from being forhtcoming for your pup?  Knowling full well that she herself can easily make it possible for you to get the papers by simply signing as stud owner at time of mating? 

At the very least, make certain your attorney knows this fact and speak with him about including DH in any lawsuits you are considering pursuing in this matter.  At the current time Daniela is the only one that can assist you in getting your papers immediately.

I will probably regret posting anything to this thread but here goes-

Breeder trusted someone who turned out to be untrustworthy, bred and sold pups believing everything would be fine, papers would arrive in order in a timely manner, etc. Been there, done that... Fortunately for me, everything DID end up fine, but probably largely luck and the grace of God. Had some really nervous months there for awhile years ago for a very similar situation. 

In fact, I VERY nearly jumped into the EXACT same hole this breeder finds herself in a couple of 2-3 years back. Just lucky again?... or maybe it was 20 years of gut instincts and the $100K it cost me to develop those instincts that caused me to step around that hole.  Either way- There but for the grace of God....

I hope you all get it straightened out.

Carolyn, my point is that you started this post with the stated intent of getting papers on Voxi. If that is indeed your goal, then sueing Kimberly in court for papers will gain you nothing as she has no papers (so far) to provide you. It would be a different matter if she were deliberately trying to withhold papers, but that is not the case. The bottom line is that your lawyer fees would be better spent assailing the AKC and Daniela, because therein lies your path to success. Whatever opinion you may have of Kimberly, it is in her best interests to obtain AKC papers on her litters, for ALL her clients, including you. Perhaps your lawyer can succeed in bringing DH to justice, or persuading AKC to grant papers on the "V" litter. That would be a good use of time and money. -Yvette

So what would I do if I were in your shoes, Carolyn? Personally I have been vastly disappointed by the courts, as they do not deliver judgements that reward the righteous, only the side that has been most "persuasive" in court. Here's a couple options that I would contemplate... a) return the dog for a full refund, b) keep the dog and negotiate a partial refund, c) keep the dog and negotiate a discount on another puppy - with papers - out of future breeding with no "incumbrences" i.e. DH, associated with the paperwork. But this is just my opinion on the matter, and you may choose to do as you will. -Yvette

Mark, if you would like to track the "paper trail" of the alleged ownership of Nando since he has been imported, the best source of facts would be Kimberly herself since she has all the documentation. Beings that she has court cases in play to obtain AKC paperwork on puppies, she is not allowed - per her lawyer - to post information on a public unmoderated forum such as this. However, if you contact her privately I would expect her to be able to provide you with more pertinent details. -Yvette

    Carolyn,   There are still things that don't make sense to me...why are registration papers so important in this transaction to you in the first place, if you had no intentions of breeding the dog when you purchased her?  I have seen proof that you did indeed purchase this dog as a pet.   If you simply want to show that she is purebred, you yourself could easily have a pedigree done up to show the dog's ancestry, and/or I am sure that Kimberly could provide you one as well, and then follow up with DNA testing to confirm parentage on the sire and dam of your pup...not a problem there. 

And if for whatever reason it is actually important to you to get this dog registered...even though you never planned to breed the dog... it seems only logical and reasonable that you should wait for Kimberly to go through the proper channels, as she is doing with both AKC and the SV and the court system, in order to obtain that for you and all of her other clients with puppies of litters sired by Nando. 

Knowing that it does take some time with a NORMAL transaction on foreign registration, and then factoring in the situation having been made all the more difficult because of DH... again, it would be reasonable for you to wait it out while Kim continues this process.

Mark, you said it's obvious I am friends with Kim so of course I will back her...
I never knew Kim nor had any knowledge of her kennel until she began the process of shipping the female "Gesi" to me that Daniela sold to me.  Kim had Gesi and cared for her for a year for Daniela, and discovered first hand the outright lies that Daniela told me about this dog in order to sell the dog to me after I informed her on the facts of my purchase from DH. 

Had she known the kind of person DH was she would not have been connected with her, nor would I.  
No one would...problem is that this did not become known to Kim in the beginning.
DH is very good at sucking people in to participate, oftentimes without their knowledge right under their own noses.

Since I met Kim, we have spoken via phone many, many times, for hours on end as she relays to me the details of unimaginable fraud she has been dealt by Daniela.  Her facts never change...

You can believe if you like that she can tell me anything just to suit her purpose...but she has shown me paperwork proof to back up everything she says. I have also dealt with AKC and the SV myself over not getting papers from DH,  and I know exactly what Kimberly is going through.  She is an honest and caring person who follows the right path.

Part of Kim's  DH fraud is nearly identical to what I have experienced with Daniela so I know she tells the truth...
I am in a similar situation as Kim, with one exception >>
I didn't have any pups to sell to my clients out of the dog DH sold me....

I guess you could call me lucky on that one, because I would be trying to figure out how to get papers to my clients over a year later just like Kim is now.  (Gesi was purchased in June 2007)
