 I am nearly in tears for you, I am so sorry this happened.
In the US, in many states that have a lemon law - it says that the breeder has the right to have the dog seen by there own vet to confirm that there is a problem.

What is shocking to me, is that you raised this dog for 8 months, and they had it for 12 days and decided that you had no weight in such a decision. I am so sorry again for your loss.

Where to go now?

My thoughts are,

(a) To contact our A.V.A. with a written report of how this puppy was miss diagnosed and euthanized without any further ado, the puppy owner had already spent,
$340.00 for desexing,
$118.00 for the xray,
they then spent
$191.00 for euthanasia and disposal, (I have never seen a client charger so much for euthanasia)
they could have save more than $120.00 had they sent the xray for a specialist opinion which would have only set them back $70.00 and they would still have the puppy. No wonder I shake my head.

(b) Do a written report of how this all came about and send with the attached specialist report and xray to all of our large breed dog clubs so that they can make all members aware of how easily it can happen to one of their puppies.

(c) Put it on as many forums as I can so that all breeders can learn from it and enclose warning to all their puppy buyers,

(d) Send a copy to the Canine Council,

If you have had the x-rays reviewed as normal, proving the pup had no dysplasia,  make sure you keep any  e-mails you have recieved about this from the buyers and their vets,  They are now evidence that the buyer attempted to claim money from you fraudulently. If you can get two vets to review the x-rays and give you a written statement all the better. Evidence that will stand up very well in court should you decide to sue for the emotional distress they have caused you.

Bev, I have had the xray evaluated by a specialist radiologist, of which we have 3 here in Oz and yes I have every record that I have recieved from the buyer, we have only had 1 phone  contact since the one informing me that she had been PTS because of HD. The only record that I do NOT have is the opinion of the vet who originally diagnosed her HD, who claim that they did not tell the buyer that the puppy had HD nor did they advise them that she should be PTS.

Complain to the Board you think the dog was misdiagnosed and put to sleep without cause.  First state what your consulting vets opinions are and attach them.  In the complaint to the vetrinary board state that you were told the dog was put down due to dylpasia on the advice of the vet (attach a copy of the letter saying so) and an affidavidt from you saying you were told by the euthanizing vet clinic the hip X-ray was not even of sufficent quality to diagnose dysplasia and the animal was still put down.  At minimum, there will be an investigation and you will get some sort of facts and maybe if you request the file from the Board, the X-Ray and opinion that you are missing.  

They will either find the dog had dyplasia (not misdiagnosed) -clearly not the case, or it did not or could not be determined and the dog was killed for no reason.

I would not give those sons of Bs the time of day, not a single cent.  Something rotten in Denmark. 

ASSHOLES!!!!  I had to rescue a doberman pup I bred from morons that turmed it in to animal control saying it was vicious after it nipped their son...Went through hell and had to lean on the city very hard to get that puppy back as technically I was no longer the owner. 

I am so sorry you have to go through this hell right now.

I would not give those sons of Bs the time of day, not a single cent.  Something rotten in Denmark.  I would welcome a lawsuit so I could force them all to produce the x-rays etc.!  You could countersue because if they are trying to fraudulently obtain money from you by making false claims then they are also criminally and civilly liable.

Oh, and if you change your contract, put in a clause that says before the dog is to put down you are given the option to take the dog back.  Failure to adhere to this clause will result in the breeder not being responsible for the refund of any amount of the purchase price or vet bills and void any warranty.


This is reasonable and probably will at least prevent them from doing this kind of thing and testing the courts.

About fifteen years ago there was a vet here who was a "buncher"-- collecting dogs and selling them for research. It came to light by clients taking in absolutely healthy dogs to be spayed or neutered and dropping them off at the vet for the procedure. When they went to back later to pick their dog up, the vet would tell them he had to put them down for this reason or that. I friend of mine took a young GSD male to that vet to be neutered and when she went back later in the day to pick him up she was given the bs line that he had to be put down. She asked for her dog's body so she could bury him at home. They gave her a black bag with a body in it. When she got home she was shocked to find the bag did not contain her dog! She called the vet and was given another bs story. Eventually this "veterinarian" was run out of town on a rail!!! This is why I ABSOLUTELY will NOT drop a dog of mine off at any vet's office no matter what. Did those new owners actually see the dog's body?
